OptimoRoute Inc. (“OptimoRoute”, “we”) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. OptimoRoute has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. OptimoRoute has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Compelled disclosure
OptimoRoute may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
Choice and means to limit use and disclosure
OptimoRoute adheres to the Data Privacy Framework’s Choice principle. In practice, this means:
No use for new purposes without consent: We do not use personal data for any purpose materially different from the purpose disclosed at the time of collection (or subsequently authorized by the individual). If we ever need to use personal data for a new, materially different purpose, we will first obtain the individual’s consent or provide an opportunity for them to opt out.
No third-party disclosures for independent use: We do not disclose personal data to any third-party controller (i.e., outside OptimoRoute) except to our service providers (agents) who process data on our behalf under contract. We do not sell or share personal data with third parties for their own marketing or other independent uses. If in the future we were to disclose personal data to any third party outside this scope, individuals would be given the opportunity to opt out of such disclosure.
Marketing communications opt-out: Individuals can opt out of receiving marketing or promotional emails from OptimoRoute at any time by clicking the “unsubscribe” link included in those emails. Once an individual unsubscribes, we will cease sending them marketing communications.
Cookie and tracking choices: Visitors to our website can control the use of non-essential cookies and similar tracking technologies. On their first visit (and any time thereafter via our cookie settings), users have the option to decline analytics, tracking, and other non-essential cookies.
Contact to limit use/disclosure: If at any point an individual wishes to further limit the use or disclosure of their personal data, they may contact us at privacy@optimoroute.com with their request. We will consider and honor such requests in line with the DPF Principles.

Enforcement
The Federal Trade Commission has jurisdiction over OptimoRoute’s compliance with the EU- U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).
In accordance with the DPF, OptimoRoute is also liable for onward transfers to third parties that process personal information in a way that does not follow the DPF unless OptimoRoute was not responsible for the event giving rise to any alleged damage.

In the event we are unable to resolve your concerns or you do not receive timely acknowledgment of your DPF related complaint from us, you can contact our third party dispute resolution provider JAMS free of charge.
In some cases, the DPF gives you the right to pursue binding arbitration. You can do this to resolve complaints not resolved by OptimoRoute or our third party dispute resolution provider, as described in Annex I to the DPF Framework.
